The General Conditions of Contract regulate the distance selling relationship between BABY NIT SL and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998, of 13 April, on General Conditions of Contract, Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce.
BABY NIT SL reserves the right to carry out the modifications that it considers opportune, without previous warning, in the General Conditions. These modifications may be made, through its websites, by any means admissible by law and will be of obligatory compliance during the time they are published on the web and until they are not validly modified by subsequent modifications. Nevertheless, BABY NIT SL reserves the right to apply, in certain cases, Particular Conditions of Contracting with preference to the present General Conditions when it considers it appropriate, announcing them in due time and form.
The purpose of the website is the manufacture of clothing.
The duration of the contract shall be linked to the delivery of the product without prejudice to the right of withdrawal.
As a user or client, you expressly declare that you know, understand and accept the conditions of use and these general contracting conditions. Likewise, you declare that you are of legal age and have the necessary legal capacity to access the websites of BABY NIT SL and to contract through them.

In accordance with the applicable and current legislation on data protection, BABY NIT SL informs users that the personal data collected during the registration process and subsequent purchase, will be incorporated into the processing system owned by BABY NIT SL, in order to process such actions by the user and manage subsequent actions arising from them.
Your data will be kept for the period of time strictly necessary to fulfil the purposes set out above, unless there is a legal obligation to keep them.
We inform you that the legal basis for the processing of your data is the correct execution of the contract between the parties and consent.

You may address your complaint to the competent supervisory authority.
During the purchase process you must identify yourself with the user name and password provided. These data will not be made public. You are responsible for the confidential and responsible treatment of the identity and password obtained during registration as a customer, and may not pass them on to anyone else. You can modify the information registered at any time, in your customer area. In this same section you will have access to a history of your orders, this is only a consultation section but its management is allowed, and the user can delete those records that he/she considers it is not necessary to view.
Once the purchase process has been completed, the customer will receive a confirmation of the purchase by e-mail. It is essential that during the purchase process the user indicates a valid email address. Upon receipt of the product at the delivery address provided, the customer will receive an invoice or a copy of the order.
Offer and validity
In the case of a product on offer, the offer price and the validity of the offer shall always be indicated next to the essential characteristics of the product.
In compliance with current regulations, BABY NIT SL offers information on all the articles on sale, their characteristics and prices. However, BABY NIT SL reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of the same. In this way, the products offered at any given time on the website will be governed by the General Contracting Conditions in force in each case. Likewise, the company shall have the right to stop offering, without prior notice and at any time, access to the aforementioned products.
Essential product characteristics
The products offered in our online shop, incorporate a photograph and the essential characteristics of the same, this is the information obtained from the manufacturer itself. The colour of the product, observable in the photograph is not binding. It is identified in the characteristics.
Guarantees
All the products offered on the website enjoy the commercial guarantee of the supplier of the product. BABY NIT SL has an after-sales service, while the guarantee is in force, the client will be able to execute it going to the establishment of BABY NIT SL, to the after-sales service, by contact form or to the points established by the own supplier. Prices
All products indicate the selling price in Euros and include Value Added Tax (VAT). If any other tax is applicable, this will be indicated (IGIC or IPSI).
Delivery and transport costs
BABY NIT SL ships to mainland Spain, Balearic Islands, Canary Islands and Europe, we do not ship to Andorra.
BABY NIT SL will charge an amount of 5 Euros for national shipments and 15,00 Euros for international shipments as shipping costs.
The customer will be able to view the shipping and transport costs before finalising the purchase.
Methods of payment
The customer may pay the amount of his order in any of the following ways. You must indicate your choice during the purchase process:
- Credit card VISA or MASTERCARD
All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All information you transmit to us travels encrypted over the network.
Likewise, your credit card details are entered directly on the bank's website, at the bank's POS (Point of Sale Terminal) and are not entered or registered on any BABY NIT SL server.

Likewise, your credit card details are entered directly on the bank's website, in the Virtual POS (Stripe) and are not entered or registered in any server of BABY NIT SL. To pay you will connect directly to the Stripe electronic payment platform.

When paying by VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiry date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.
This payment method is valid only on the website.
If the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and credit entries shall be made as soon as possible on the accounts of the supplier and the cardholder.
However, if the purchase had actually been made by the cardholder and the demand for refund was not the result of having exercised the right of withdrawal or termination and, therefore, had unduly demanded the cancellation of the corresponding charge, the cardholder shall be liable to BABY NIT SL for compensation for damages caused as a result of such cancellation.
- Bank transfer
When you select bank transfer, you will receive, together with the confirmation of your order, an e-mail with the bank details of BABY NIT SL.
It is very important that when making the transfer you indicate in the subject line the order number, as well as your name and surname, and make the transfer within 3 days after the order confirmation date in order to validate the order.
If you wish, you can send us proof of the transfer via the contact form. But in any case, the order will not be considered effective until our administration department does not have bank confirmation of the transfer.
Please note that payment must be made in EUROS and that any exchange and bank charges are your responsibility.
In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer, you always inform your bank to take charge of the commissions in origin, those bank commissions and expenses corresponding to your bank. Otherwise, BABY NIT SL could stop the shipment of your order if we do not receive the full amount of your order.
Any exchange and bank charges are to be borne by the customer.
Execution of the service
BABY NIT SL informs that the delivery of the order to national territory can take between 2 and 3 working days. International shipments may take between 2 and 6 working days. Except when BABY NIT SL does not have stock, then it may take up to a maximum of 30 calendar days.
The availability of the products offered by BABY NIT SL may vary depending on customer demand. Although BABY NIT SL updates the stock periodically, the product requested by the client could be out of stock at that moment. In case of non-execution by unavailability, BABY NIT SL in the moment that it has knowledge of this situation will notify it to the client, by means of an electronic mail. The period of this communication will not exceed in any case the maximum term of 30 days. BABY NIT SL will be able to give the double option of: to supply to the client without increase of price, a product of similar characteristics or of superior quality, or except for justified and demonstrable reasons for BABY NIT SL within this same period to pay the sums paid by the cancelled order.
Right of withdrawal
The purchaser shall have a period of fourteen calendar days to withdraw from the contract, starting from the day on which the customer receives the product, without penalty and without stating the reasons.

QUESTIONS
WHEN DO YOU RECEIVE YOUR ORDER?
The delivery time is 48 hours to the address you indicate, from the time it leaves our facilities, excluding weekends and holidays. If you are absent, the transport agency will contact you to make a new delivery attempt.
Our shipments are made with the company TIPSA, which is a reference in the parcel sector.
*During sales, Christmas or Black Friday the delivery date can be affected.
CAN I RETURN MY ORDER?
RETURN
You have 14 days to return the entire order. You can also return part of the order.
Please indicate in the form the reason and time slot (morning or afternoon) to arrange collection.
Once the goods have been received at our offices, and after checking their condition, the total or partial amount of the order will be refunded on the same platform as the payment was made, but never the shipping costs (unless we make a mistake). The payment will not be made until we have received the product and checked its perfect condition.
WHAT HAPPENS IF THE ITEM I RECEIVE HAS A MANUFACTURING PROBLEM?
Essentials WBBN is committed to providing the highest quality and total customer satisfaction. Therefore, if when you receive your order you are not satisfied with any of your items, you have a period of fourteen (14) calendar days from the date of receipt of your order to return them.
WHAT HAPPENS IF THERE IS A PRICE ERROR ON THE WEBSITE?
Telematic errors in prices on the web do not condition the shipment of the model. Therefore, if due to a telematic error an article shows a price that is not correct, it will not be sent unless the correct amount is paid.
Return of the defective product
In the event that the product is not in good condition and the causes attributable to it are not the result of the customer, the customer will have the right to return the product, informing BABY NIT SL of the reason for return through any of the means provided in these conditions of contract, and at no cost to the customer. This return due to a defect or poor condition of the product will not be considered a right of withdrawal.
BABY NIT SL undertakes to assume the cost of the return and to return the product for a new one in accordance with the conditions accepted at the time of sale.

Jurisdiction
Likewise, BABY NIT SL reserves the right to bring any civil or criminal action it deems appropriate for improper use of its website and contents or for non-compliance with these conditions.
The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Should any controversy arise, the parties may submit their disputes to arbitration or go to ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard.
